拾趣是一个免费的 App，用来收集身边的小美好。你拍的、写的都归你；图鉴和活动信息只是参考；出门时请照顾好自己。
关于这些条款
用拾趣（iPhone 和 Android 上的 App，以及这个网站）就表示你同意这些条款和隐私政策。App 由 Holding Systems Pty Ltd（ABN 48 695 538 115，澳大利亚悉尼，下文的「我们」）提供。不同意的话，请不要使用。
使用 App
- 拾趣供个人、非商业使用。
- 请不要用脚本或其他方式大量调用识图和服务器，也不要试图绕过每天的次数限制。
- 请不要用拾趣做违法的事，或者骚扰别人。
- 一起走里，请友善待人。
你的照片和记录
- 你在拾趣里拍的照片、写的便签和收集记录，都是你的。版权始终归你。
- 为了让 App 能工作，你允许我们在你发起相应操作时存储、复制、缩放和传输这些内容：比如你点「认一认」时把那张照片发给识图服务，你开启备份时把它们存到我们的服务器，你在一起走里开着「让同伴看到我的照片」时把那张照片给同行的人看（和朋友的徒步默认开着，徒步页上随时可以关掉）。这个许可只为了完成你要做的事，不包括其他用途。
- 我们不会把你的照片用于广告、对外展示、官网或应用商店页面，也不会用它们训练模型，除非你逐张勾选同意。
- 将来如果你把某张照片「借给图鉴」，就是允许我们在拾趣的图鉴和从图鉴生成的分享图里展示它，并署你的昵称。你随时可以收回，收回后我们会在 30 天内从图鉴和服务器上移除它；别人已经保存到自己手机上的分享图我们管不到。
- 你自己导出和分享的图片和短片，我们不保存。分享图里如果用到其他摄影师的参考照片，图上会带他们的署名，请保留。
- 删除账号后，我们服务器上的照片和记录会被删除。退出登录只是停止备份，已备份的内容会留到你下次登录；要删掉它，用「我的 › 设置」里的「删除账号和云端备份」。一起走里分享的照片最迟在徒步结束 7 天后删除。
- 请只上传你自己拍的、或有权使用的照片，并尊重别人的隐私。
图鉴、插画和参考照片
- App 里的文字、插画、贴纸和花园画是我们的作品。你可以在 App 里使用，也可以把 App 生成的分享图和短片发给朋友或发到社交平台。请不要把它们单独拿去商用。
- 图鉴里的参考照片和鸟叫声来自 iNaturalist 和 Wikimedia Commons 上的摄影师和录音者，按知识共享（CC）许可使用，不是我们的。每一张的作者和许可都写在 App 的「我的 › 设置 › 查看全部来源」里；分享图上带的署名请保留。
认一认只是参考
识图由 AI 完成，会认错。请不要凭它判断一种植物或蘑菇能不能吃、一种动物安不安全。遇见野生动物，保持距离就好。
活动信息
「这周的悉尼」里的活动来自主办方的公开信息，时间、地点和价格都可能变。出发前请到主办方页面确认一下。我们不是主办方，票务、退款和现场安排都由主办方负责。
一起走
徒步由用户自己发起和组织，我们不核实参与者的身份。结伴出门请自己留意天气、路况和同伴，邀请码只发给你认识的人。
账号
App 不用登录也能用。用 Apple 或 Google 登录只为开启备份。「我的 › 设置」里随时可以删除账号和云端备份，立刻生效。
责任
拾趣免费提供，我们会尽力把它做好，但不能保证没有错误或永不中断。澳大利亚消费者法赋予你的保障不受这些条款影响。在法律允许的范围内，我们不对因使用 App 产生的间接损失负责。
变化
这些条款如有更新，会在这个页面公布并改动日期。重要变化会在 App 里提醒你。更新后继续使用，就表示同意新版本。
适用法律
这些条款适用澳大利亚新南威尔士州的法律。

Hey Magpie is a free app for collecting the small wonders around you. What you take and write is yours; the Guide and event listings are a guide, not a guarantee; and please look after yourself out there.
About these terms
By using Hey Magpie (the app on iPhone and Android, and this website) you agree to these terms and to the Privacy Policy. The app is provided by Holding Systems Pty Ltd (ABN 48 695 538 115), Sydney, Australia ("we" below). If you do not agree, please do not use it.
Using the app
- Hey Magpie is for personal, non-commercial use.
- Do not call the identification service or our servers in bulk, by script or otherwise, or try to get around the daily limits.
- Do not use Hey Magpie for anything unlawful, or to harass anyone.
- In Walk Together, be kind to each other.
Your photos and records
- The photos you take in Hey Magpie, the notes you write and your collection are yours. You keep the copyright.
- So the app can work, you let us store, copy, resize and transmit this content when you ask for an action that needs it: sending a photo to the identification service when you tap Identify, keeping copies on our servers when you turn on Backup, and showing a photo to the people on a walk while "Let companions see my photos" is on for that walk in Walk Together (on by default for a walk with friends; the switch on the walk page turns it off). This permission exists only to do what you asked and covers nothing else.
- We will not use your photos in advertising, public showcases, our website or store listings, and we will not use them to train models, unless you opt in for a specific photo.
- In future, if you "lend a photo to the Guide", you allow us to show that photo in the Hey Magpie Guide and in share pictures made from it, credited to your nickname. You can take it back at any time; within 30 days of that we remove it from the Guide and our servers. Share pictures other people have already saved to their own phones are beyond our reach.
- We do not keep the pictures and clips you export and share yourself. When a share picture includes another photographer's reference photo, it carries their credit; please leave it in place.
- When you delete your account, your photos and records on our servers are deleted. Signing out only stops backing up: what is already backed up stays until your next sign-in, and "Delete account and backup" in Me › Settings removes it. Photos shared in Walk Together are deleted no later than 7 days after the walk.
- Only upload photos you took or have the right to use, and respect other people's privacy.
The Guide, the artwork and the reference photos
- The text, illustrations, stickers and Garden art in the app are our work. You may use them in the app and send the share pictures and clips the app makes to friends or social platforms. Please do not take them out on their own for commercial use.
- The reference photos and bird calls in the Guide come from photographers and recordists on iNaturalist and Wikimedia Commons, used under Creative Commons licences, and are not ours. Each one's author and licence is listed under Me › Settings › See all sources in the app; please leave the credit on a share picture in place.
Identify is a guide, not a verdict
Identification is done by AI and gets things wrong. Do not rely on it to decide whether a plant or mushroom is safe to eat, or whether an animal is safe to approach. With wildlife, keeping your distance is enough.
Events
The events in "This week in Sydney" come from the organisers' public information, and times, places and prices can change. Check the organiser's page before you set out. We are not the organiser: tickets, refunds and what happens on the day are theirs.
Walk Together
Walks are started and organised by users, and we do not verify who takes part. When you head out with others, keep an eye on the weather, the path and your company, and only send invite codes to people you know.
Accounts
The app works without signing in. Sign in with Apple or Google is only for Backup. In Me › Settings you can delete your account and backup at any time, with immediate effect.
Liability
Hey Magpie is free. We do our best to make it good, but we cannot promise it will be free of errors or never interrupted. Nothing in these terms limits the guarantees you have under the Australian Consumer Law. To the extent the law allows, we are not liable for indirect loss arising from your use of the app.
Changes
Updates to these terms are posted on this page with a new date. We will tell you in the app about important changes. Using the app after an update means you accept the new version.
Governing law
These terms are governed by the laws of New South Wales, Australia.
